ALREADY WITH AN ESTATE AGENT?

If you have already signed up with an estate agent to sell your property and you wish to sell privately then you need to have a look at the contract that you have signed.

There are a few different types of contract that you could have signed. These are:

1.    SOLE AGENCY

2.    SOLE SELLING RIGHTS

3.    DUAL OR MULTIPLE AGENCY

The most common of these is the SOLE AGENCY, and each one is described below.

1.    SOLE AGENCY

With ‘sole agency’ the estate agent you have signed up with is the only agent with the right to sell your property, however, as you are not an estate agent and privatepropertysales.org is not an estate agent you should not have a problem if you find your own buyer. They usually operate a ‘no sale no fee’ policy and if you want to go to another agent then so long as you follow their terms and conditions for giving notice etc. then you are free to change agent.

2.    SOLE SELLING RIGHTS

With ‘sole selling rights’ the agent is the only person with the right to sell your property. If you were to find a private buyer or change estate agents you would still be liable to pay the original agent no matter who sold the property for you. This kind of contract is rarer than the sole agency agreement, however, there are still some agents presenting this kind of contract in the full knowledge that customers do not fully understand it’s implications.

3.    DUAL/MULTIPLE AGENCY

With dual or multiple agency agreements you are free to appoint two agents (or more in the case of multiple agency) to sell your property. The agent who sells the property is usually the one who claims the commission. You may find with this kind of agreement that the commission fees are raised if the agents decide that they are going to split the commission.

In all cases we strongly recommend that you speak with your agent and advise them that you wish to advertise privately just to make sure that if you do find your own buyer you will not be liable to pay their commission fees. This is important as you do not want to incur unnecessary costs.

Many private sale sites will not advise you of this as they just want you to sign up and list your property for sale; however, we pride ourselves on our honesty and openness and put our customers first.
